These Terms & Conditions apply to the Beauté Mafia Direct same day delivery service provided by Beauté Mafia Pty Ltd (“Beauté Mafia”, “we”, “us” or “our”).

By selecting Beauté Mafia Direct at checkout, the customer agrees to these Terms & Conditions in addition to Beauté Mafia’s general Terms & Conditions, Shipping Policy and Refund Policy.

1. Service Availability

Beauté Mafia Direct is a premium local same day delivery service available only to eligible delivery addresses within our designated service areas.

Availability is determined by the delivery address entered at checkout and may vary according to location, delivery capacity, operating days and other operational factors.

The appearance of Beauté Mafia Direct at checkout confirms that the address is within an eligible delivery zone but does not guarantee a particular delivery time unless expressly stated.

2. Operating Days & Order Cut-Off

Beauté Mafia Direct currently operates Wednesday to Friday, excluding public holidays and other dates on which the service is unavailable.

Orders must generally be placed before 10:30 am to qualify for same day delivery.

Orders placed after the applicable cut-off may be delivered on the next available Beauté Mafia Direct delivery day.

Beauté Mafia reserves the right to temporarily modify operating days, cut-off times or service availability where reasonably necessary.

3. Delivery Window

Eligible same day orders are generally delivered between 12:00 pm and 6:00 pm.

Delivery times are estimates and are not guaranteed appointment times.

Customers should ensure that they or another authorised person are available to receive the order during the applicable delivery window unless Authority to Leave has been provided.

4. Delivery Zones & Fees

Beauté Mafia Direct delivery fees are determined by the customer's delivery location and the applicable delivery zone displayed at checkout.

The applicable fee will be clearly displayed before the customer completes their order.

Delivery zones, boundaries, pricing and availability may be changed from time to time.

Addresses outside our standard delivery areas may contact Beauté Mafia for a custom delivery quote. Acceptance of a custom delivery request is at our discretion and subject to availability.

5. Same Day Delivery Availability

Same day delivery is subject to:

• the order being placed before the applicable cut-off;
  
• the delivery address being within an eligible service area;
  
• the products being available for immediate fulfilment;
  
• delivery capacity being available; and
  
• circumstances reasonably permitting us to complete the delivery.
  

Limited same day delivery positions may be available on any given day.

6. Customer Delivery Information

Customers are responsible for providing complete and accurate delivery information, including their:

• full name;
  
• delivery address;
  
• apartment, unit, building or access details where applicable;
  
• mobile telephone number; and
  
• any necessary delivery instructions.
  

Beauté Mafia is not responsible for delays or failed deliveries caused by incorrect, incomplete or inaccessible delivery information supplied by the customer.

Additional delivery charges may apply where another delivery attempt is required because of incorrect information, restricted access or circumstances within the customer's control.

7. Access to the Property

The customer is responsible for ensuring reasonable and safe access to the nominated delivery location.

This includes providing any required gate codes, building access instructions, concierge information, unit numbers or other information reasonably required to complete the delivery.

Beauté Mafia and its delivery representatives are not required to enter a property or location that is unsafe, inaccessible or where doing so could reasonably create a risk to a person, vehicle or property.

8. Recipient Availability

We recommend that the customer or another authorised person be present to receive the order.

Where no Authority to Leave has been provided and nobody is available to receive the delivery, Beauté Mafia is not required to leave the order unattended.

The order may be returned to Beauté Mafia and a reasonable redelivery fee may apply before another delivery attempt is made.

9. Authority to Leave

If the customer requests, selects or otherwise provides Authority to Leave (ATL), the customer authorises Beauté Mafia or its delivery representative to leave the order unattended at the nominated delivery address without obtaining a signature or handing the order directly to a person.

By providing Authority to Leave, the customer acknowledges and agrees that:

• the customer accepts the risks associated with leaving the order unattended, including theft, loss, weather exposure, heat exposure, accidental damage, interference by third parties or animals, or other damage occurring after delivery;
  
• Beauté Mafia will take reasonable care to leave the parcel in a location considered reasonably safe and suitable where one is available;
  
• once the parcel has been delivered to the nominated address in accordance with the customer's Authority to Leave instructions, the delivery is considered completed and fulfilled;
  
• Beauté Mafia or its delivery representative may take a photograph of the parcel at the delivery location as proof of delivery;
  
• the customer accepts that a delivery photograph, together with our delivery records where applicable, may be relied upon as evidence that the order was delivered to the nominated address; and
  
• subject to any rights that cannot be excluded under Australian Consumer Law, Beauté Mafia is not responsible for theft, loss or damage occurring after the order has been properly delivered and left in accordance with the customer's Authority to Leave instructions.
  

Customers who do not wish to accept these risks should not provide Authority to Leave and should ensure that they, or another person authorised by them, are available to receive the delivery.

10. Proof of Delivery & Completion

Beauté Mafia may record reasonable evidence of delivery, including a time-stamped delivery photograph, delivery time, delivery location, driver records and/or electronic delivery records.

Where an order has been delivered to the correct nominated address and either:

(a) handed to the customer or another person at the address; or

(b) left in accordance with a valid Authority to Leave instruction,

the delivery will be regarded as completed.

Where Authority to Leave applies, a photograph may be taken showing the parcel at the delivery location. The customer acknowledges that this photograph may constitute proof that the delivery component of the order has been fulfilled.

Once an authorised unattended delivery has been properly completed, responsibility for the security and protection of the parcel passes to the customer, to the extent permitted by law.

Beauté Mafia is not responsible for a parcel subsequently being stolen, removed, interfered with or damaged after a properly completed Authority to Leave delivery, except where the loss or damage was caused by an act or omission of Beauté Mafia or its delivery representative, or where liability cannot lawfully be excluded.

11. Failed Delivery & Redelivery

A delivery may be considered unsuccessful where, for example:

• nobody is available to receive the order and Authority to Leave has not been provided;
  
• the address cannot reasonably be located;
  
• access to the property cannot be obtained;
  
• required access instructions have not been provided;
  
• the delivery location is considered unsafe;
  
• the customer cannot be contacted where reasonably necessary to complete the delivery; or
  
• incorrect or incomplete delivery information has been supplied.
  

Where a delivery cannot reasonably be completed due to circumstances within the customer's control, the order may be returned to Beauté Mafia.

A redelivery fee may apply, including where another delivery journey is required.

12. Delivery Delays

While we aim to complete eligible orders within the stated same day delivery window, delivery times cannot be guaranteed.

Delivery may be affected by circumstances including traffic, accidents, road closures, severe weather, vehicle issues, unusually high order volumes, access difficulties or other circumstances beyond our reasonable control.

Where reasonably practicable, we will endeavour to communicate significant delays.

A delay alone does not automatically entitle the customer to a refund of the order where the goods are subsequently delivered, subject always to the customer's rights under Australian Consumer Law.

13. Changes or Cancellation After Dispatch

Once an order has been prepared or dispatched for same day delivery, we may be unable to change the delivery address, delivery instructions or cancel the delivery.

Customers should contact Beauté Mafia as soon as possible if a change is required.

Additional charges may apply where a requested change requires rerouting, redelivery or an additional delivery journey.

14. Products Requiring Particular Handling

Certain beauty, skincare, fragrance and cosmetic products may be sensitive to prolonged heat, direct sunlight or environmental exposure.

Customers providing Authority to Leave should consider whether their nominated location is appropriate for the products ordered.

Where reasonably possible, Beauté Mafia will endeavour to place an authorised unattended delivery in a protected location.

15. Inspection of Orders

Customers should inspect their order as soon as reasonably practicable after receiving it.

If an item appears to have been damaged before or during delivery, is incorrect, or an item is missing, customers should contact Beauté Mafia promptly and provide photographs or other information reasonably required for us to investigate the matter.

A delivery photograph confirms delivery but does not remove any rights the customer may have in relation to faulty, damaged, incorrect or otherwise non-compliant goods under Australian Consumer Law.

16. Liability

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

To the extent permitted by law, Beauté Mafia is not responsible for loss, theft or damage arising after an order has been properly delivered in accordance with an Authority to Leave instruction.

Beauté Mafia is also not responsible for delays or unsuccessful delivery caused by inaccurate customer information, inaccessible premises or circumstances outside our reasonable control, except to the extent that liability cannot lawfully be excluded.

17. Service Refusal or Suspension

Beauté Mafia reserves the right to refuse, suspend or cancel Beauté Mafia Direct delivery where reasonably necessary, including where:

• the delivery address is outside the service area;
  
• conditions make delivery unsafe;
  
• access is unreasonable or unavailable;
  
• there is suspected fraud or misuse of the service;
  
• circumstances outside our reasonable control prevent delivery; or
  
• the order otherwise cannot reasonably be fulfilled through the service.
  

Where Beauté Mafia cancels a paid same day delivery service for reasons not attributable to the customer, any applicable delivery fee will be refunded where required.

18. Changes to the Service

Beauté Mafia may update the availability, delivery areas, operating days, delivery windows, cut-off times, pricing and these Terms & Conditions from time to time.

The terms applicable to an order are those presented or otherwise applicable when the customer places that order.
